A presente dissertação tem como objetivo refletir acerca das potencialidades da habitação pública, de custos controlados ou para arrendamento acessível para a resolução da crise da habitação que se tem vindo a acentuar nas últimas décadas em Portugal. Para tanto, além da exposição dos contornos essenciais da crise, reflete acerca dos instrumentos de gestão territorial e do papel desses e de outros meios, concretamente do PDM (Plano Diretor Municipal) e da CMH (Carta Municipal de Habitação), para dar resposta aos défices habitacionais. O trabalho acaba por identificar um hiato persistente entre o ideal constitucionalmente previsto e a realização da garantia do direito à habitação, que pode ser colmatado pela ação do Estado no que diz respeito ao acesso à habitação em condições que não comprometam o princípio da igualdade previsto na CRP.
This dissertation aims to examine the potential of public housing, cost-controlled housing or affordable rental housing as a solution to the housing crisis that has been intensifying in Portugal over recent decades. To this end, in addition to outlining the key aspects of the crisis, it examines spatial planning instruments and the role of these and other tools – specifically the Municipal Master Plan (PDM) and the Municipal Housing Charter (CMH) – in addressing housing shortages. The study ultimately identifies a persistent gap between the constitutional ideal and the realisation of the right to housing, which can be bridged by state action regarding access to housing under conditions that do not compromise the principle of equality fixed in the CRP.
