| dc.description.abstract | O objetivo geral deste estudo consiste na compreensão do processo de tomada de decisão por medidas restaurativas no âmbito tutelar educativo. Recorrendo a uma amostra de seis magistrados, com experiencia (presente ou passada) no sistema tutelar educativo, acedemos às suas perspetivas sobre medidas restaurativas. Os resultados revelam que, na perspetiva dos magistrados, toda a Lei Tutelar Educativa é restaurativa, nomeadamente as medidas tutelares de cariz não institucional. No entanto, contrariando o argumento de que “todas as partes” implicadas num conflito devem ser incluídas nas práticas restaurativas (Marshall, 1996), os magistrados centram-se no jovem ofensor em detrimento da vítima quando abordam os processos tutelares educativos e a sua dimensão restaurativa. É ao jovem ofensor que atribuem mais vantagens na aplicação de medidas restaurativas e os critérios de tomada de decisão neste âmbito focam-se igualmente no ofensor, sendo o tipo de crime, a idade e a dinâmica familiar do jovem ofensor os critérios mais consensualmente apontados pelos magistrados | pt_PT |
| dc.description.abstract | The overall purpose of this study is to understand the decision-making process by restorative measures within juvenile justice system. Using a sample of six magistrates with experience (past or present) in the educational tutelary system, we accede to their perspectives on restorative measures. The results show that, from the perspective of magistrates, all the law educational tutelary is restorative, including non-institutional tutelary measures. However, contrary to the argument that "all parties" involved in a conflict shall be included in restorative practices (Marshall, 1996), the judges are centered on young offender to the detriment the victim when addressing the tutorial educational processes and its dimension restorative. It is the young offender that magistrates give more advantages in the application of restorative measures and decision-making criteria in this area also focus is on the offender, and the type of crime, age and family dynamics of the young offender criteria more consensually appointed by the magistrates. | pt_PT |
