Este artigo aprecia a recente evolução da compreensão do direito à greve, em especial na medida em que ele se apresenta em rota de colisão com outros direitos e bens fundamentais. A análise é empreendida tendo por referência a jurisprudência do Tribunal de Justiça (da União Europeia), nomeadamente os Acórdãos Viking e Laval, e também do Tribunal Europeu dos Direitos do Homem, nomeadamente os Acórdãos Demir and Baykara c. Turquia, EnerjiYapi-Yol Sen c. Turquiae National Union of Rail e Maritime and Transport Workers c. Reino Unido.
This article assesses the most recent evolution of the comprehension of the right to strike, especially from the perspective of its conflict with other rights and fundamental values. This analysis is made with reference to the case law of the Court of Justice (of the European Union), mainly the Viking and the Laval rulings, and of the European Court of Human Rights, mainly the cases of Demir and Baykara v. Turkey, Enerji Yapi-Yol Sen v. Turkey, and National Union of Rail, Maritime and Transport Workers v. the United Kingdom.
