Abstract(s)
A presente dissertação versa sobre o direito à habitação, pilar fundamental na área dos direitos sociais e de garantia do bem-estar e qualidade de vida dos cidadãos. Aborda ainda as dificuldades que se fazem sentir em garantir a sua proteção de forma adequada dado que, nos últimos anos, se tem registado um aumento significativo do custo de arrendamento e aquisição de habitação; a falta de fundos não deve ser um fator relevante no impedimento do acesso à habitação. Desta forma, este direito será estudado em contexto citadino, atendendo-se às suas caraterísticas e dando relevo às medidas tomadas a nível estadual e municipal. Em particular será abordado o modo como estas conciliam princípios e direitos de ordem social (como garantir habitação suficiente e de qualidade àqueles que não têm meios para o fazer por si mesmos) com requisitos de sustentabilidade ambiental (nomeadamente através da reabilitação urbana). A nível municipal, serão tomadas como referência as medidas adotadas pelo município do Porto, destacando-se o papel que o planeamento urbano desempenha para garantir habitação acessível através do Zonamento Inclusivo. Em último lugar, serão feitas algumas sugestões de medidas a adotar de modo a permitir que mais particulares consigam aceder aos programas de acesso à habitação.
This thesis deals with right to housing, a fundamental pillar in the area of social rights connected to the well-being and quality of life of its citizens, and the difficulties its adequate protection faces, considering that in the last couple of years the cost of renting and house purchasing has increased significantly, and lack of funds should not be an impediment to fair housing choice. Thus, this right will be studied in a city context, taking into account its particular characteristics, giving relevance to the measures taken at state and city council level and in particular, to the way in which these measures reconcile principles and rights of a social order (i.e., sufficient and quality housing for those who do not have the means themselves) to environmental sustainability requirements (namely through urban rehabilitation). At city council level, the measures adopted by the municipality of Porto will be taken as a reference, highlighting the role that urban planning plays in guaranteeing affordable housing through Inclusionary Zoning. Lastly, some suggestions regarding possible measures will be made, in order to allow more individuals to access the existing housing programs.
