| dc.description.abstract | O presente trabalho incide sobre o crime de coação, analisando os vários aspetos que o constituem, dando a conhecer as demais questões que este tipo legal levanta e procurando encontrar uma solução para as mesmas. O foco principal desta investigação foi o n.º 3, do artigo 154º do Código Penal, visto que, na nossa ótica é uma norma que tem um grande impacto no tipo legal de coação e que ainda se encontra pouco estudada e debatida. Estamos em crer que é bastante importante ter uma boa compreensão desta cláusula para conseguir fazer uma distinção precisa entre condutas que devem ser punidas como crimes de coação e condutas que são socialmente aceites. Para tal, analisámos as origens desta norma e tentámos descortinar o seu funcionamento e em que situações é aplicável. | pt_PT |
| dc.description.abstract | This thesis deals with the crime of coercion, analyzing the various aspects that constitutes it, making known all the questions that it raises and trying to find a solution for them. The main focus of this investigation is the n. º 3 of the article 154º of the Penal Code, since in our opinion it’s a statue that has a big impact on the crime of coercion and has not been studied and discussed much. We believe that it is very important to have a good comprehension of this clause to be able to make a distinction between the actions that are considered coercion and those which are accepted by the society. To achieve that we have analyzed the origins of this clause and tried figure out how it works and when it is applicable. | pt_PT |
