| dc.description.abstract | O cerne da presente dissertação é a análise da transposição da Diretiva (UE) 2019/1937 do Parlamento Europeu e do Conselho de 23 de outubro de 2019 para o ordenamento jurídico português (Lei n.º 93/2021, de 20 de dezembro) e das questões que a mesma poderá suscitar. Perante o conhecimento da prática de um ato ilícito da entidade empregadora pelo trabalhador, este depara-se com o dilema de denunciar os factos cometidos e, simultaneamente, conciliar tal denúncia com os seus deveres laborais. Urge, por isso, a existência de mecanismos de proteção do denunciante e de garantias de privacidade, inclusive o anonimato da denúncia, em toda a linha que esta percorre, caso tal reflita a vontade do trabalhador denunciante. | pt_PT |
| dc.description.abstract | The core of this dissertation is the analysis of the transposition of the Directive (EU) 2019/1937 of the European Parliament and of the Council of 23rd October 2019 into the Portuguese legal system (Law n. º 93/2021, of 20th December) and the questions it may raise. Faced with the worker’s knowledge of the practice of an illegal act by the employer, the worker is confronted with the dilemma of denouncing the facts committed and, simultaneously, reconciling such denunciation with his labour duties. For this reason, there is an urgent need for whistleblower protection mechanisms and for privacy guarantees, including the anonymity of the report, along the entire line it covers, if this reflects the will of the whistleblower. | pt_PT |
