| dc.description.abstract | A presente dissertação visa elaborar uma análise teórico-prática, tanto quanto possível crítica, do crime de violência doméstica tipificado no artigo 152.º do Código Penal Português e, no âmbito do mesmo, dos meios ao dispor da vítima no decurso do processo criminal e das intervenções legislativas que se afiguram necessárias para garantir uma maior proteção da vítima e uma efetiva punição do agressor. Assim, começamos por fazer o enquadramento legal deste fenómeno, seguindo-se uma abordagem histórica do tipo legal e das alterações da lei processual penal relevantes nesta matéria e as questões que têm sido alvo de controvérsia na doutrina e na jurisprudência a respeito daquele. Num segundo momento, discorremos sobre os diplomas legais que consideramos mais pertinentes, face à perspetiva adotada na presente dissertação, e que servirão de base àquilo que pretendemos sustentar. Terminamos com o levantamento de algumas questões processuais às quais pretendemos dar resposta, através das soluções propostas que essencialmente recaem sobre mecanismos de prevenção e alterações processuais com vista à repressão criminal. Julgamos ser também imperativa a mudança do modelo social conservador que ainda rege a nossa comunidade e que está na origem da violência, mediante o reforço da educação e instrução das próximas gerações no sentido do respeito pelos direitos fundamentais de cada pessoa. | pt_PT |
| dc.description.abstract | The present dissertation aims to elaborate a theoretical-practical analysis, as much as possible critical, of the crime of domestic violence typified in the article 152 of the Portuguese Penal Code and, within the scope thereof, of the means at the disposal of the victim in the course of the criminal procedure and of the legislative interventions that appear necessary to ensure greater protection of the victim and an effective punishment of the agressor. Thus, we begin by making the legal framework of this phenomenon, followed by a historical approach of the legal type and the relevant criminal procedural law changes in this matter and the issues that have been the subject of controversy in the doctrine and jurisprudence regarding that. In a second moment, we discuss the legal diplomas we consider most relevant, in view of the perspective adopted in this dissertation, and that will serve as a basis for what we intend to sustain. We conclude with a survey of some procedural issues to which we intend to respond, through the proposed solutions that essentially fall under preventive mechanisms and procedural changes with a view to criminal repression. We believe that it is also imperative to change the conservative social model that still governs our community and that it is at the origin of violence, by strengthening the education and instruction of the next generations towards respect for the fundamental rights of each person. | pt_PT |
