Do regime jurídico-laboral dos treinadores de futebol : reflexões sobre o regime preferencial

O grupo profissional dos treinadores de futebol não tem recebido a merecida atenção por parte do legislador, não existindo, até à data, qualquer regulamentação especial capaz de tutelar e preencher as necessidades destes profissionais. Mas existirá realmente uma lacuna? Ou a solução estará na aplicação do regime laboral comum? A presente dissertação percorrerá a possibilidade de aplicação de vários regimes e diplomas legais, nomeadamente o regime da Comissão de serviço, assim como a possibilidade de aplicação analógica do regime especial dos praticantes desportivos, previsto na Lei 28/98, de 26/06. Sucede que todas estas possibilidades apresentam as suas dificuldades de aplicação prática ao contexto desportivo dos treinadores de futebol, fazendo surgir a contratação coletiva como mais uma via de resolução dos problemas, procurando conciliar os trâmites legais com as especificidades do fenómeno desportivo. Pelo caminho percorrido, analisaremos igualmente a necessidade de consagração de um regime próprio que, em definitivo, resolva esta pertinente querela jurídica.
The professional group of football coaches has not received from the legislator the amount of attention it truly deserves, mostly due to the fact that there is not a special legislation, able to fulfill the needs of these professionals. But is there a true legal gap? Or the solution lies in the application of the common labour regime? This dissertation will cover the adequacy of some legal texts, such is the regime of service commission and the analogic application of Law 28/98, of 26/06, the regime for sportsmen. But the practical application of them, may cause some troubles, so that the collective contract has been playing an important role, protecting the interests of football coaches and connecting them with the sports environment. We will also analyse the need for a unique regulation, able to solve this important issue.
