Coelho, Ana Beatriz Corredoura; Confraria, JoãoThe General Data Protection Regulation, Regulation 2016/679 of the European Parliament and of the Council, of April 27, 2016, applicable from May 25, 2018, is mandatory in all its elements and directly applicable to all member states. According to this Regulation, it is the legal responsibility of website operators to ensure that user’s personal data is collected and stored legally. One of the most common ways of sharing, collecting and storing personal data is through cookies, the so-called cookie banner. The General Data Protection Regulation requires that a website only collect personal data from users who have given their prior, free, specific, informed and unequivocal consent, for the specific purposes of its use. Therefore, it is imperative to understand data protection and electronic privacy laws, in order to legally adapt the use of this mechanism.
