A política comum em matéria de asilo desenvolvida pela União Europeia alicerça-se no respeito pelos direitos fundamentais. Nesta medida, o direito de um requerente de proteção internacional permanecer ou residir num Estado deve ser acompanhado pelo reconhecimento de um estatuto migratório que lhe garanta o acesso a um conjunto de direitos que lhe permita viver condignamente. Acresce que o princípio da igualdade é estruturante da ordem jurídica da União e, tal como resulta do artigo 21.° da CDFUE, deve interpretado em conformidade com o artigo 14.° da CEDH, impondo a não discriminação dos beneficiários de proteção internacional. Serão, neste trabalho, apresentados os contornos gerais da política de asilo europeia, a importância do princípio da equiparação no quadro do seu funcionamento, e, tendo em conta as necessidades de inclusão destas pessoas, procurar-se-á saber se o cooperativismo – também aqui - poderá ser uma resposta para a eliminação da pobreza e da pressão migratória a que os Estados-membros têm estado sujeitos.
The common asylum policy developed by the European Union is based on respect for fundamental rights. Therefore, the right of an applicant for international protection to remain or reside in a State must be accompanied by the recognition of a migratory status that guarantees access to a set of rights that allow them to live with dignity. Furthermore, the principle of equality is a fundamental principle of the Union’s legal order and, as can be seen from Article 21 of the CFREU, must be interpreted in accordance with Article 14 of the ECHR, imposing non-discrimination against beneficiaries of international protection. This work will present the general outlines of European asylum policy, the importance of the principle of equality within its functioning, and, taking into account the inclusion needs of these individuals, will seek to determine whether cooperatives—also here—can be a response to the elimination of poverty and the migratory pressure to which Member States have been subjected.
