Os textos normativos do século XIII determinam que o ofício de tabelião público fosse exercido por leigos e não eclesiásticos, renovando antiga proibição carolíngia reiterada por decretal do papa Inocêncio III datada de 1213. Revendo materiais anteriormente utilizados na sua dissertação de doutoramento sobre a génese e implantação do tabelionado e instrumento público em Portugal (1212-1279) – no essencial originais emitidos por tabeliães – o autor procura elementos relativos à acumulação do ofício tabeliónico com o estatuto clerical, tentando apurar se eram incompatíveis e se na época existia consciência dessa incompatibilidade em território português.
Thirteenth-century legal and regulatory texts established that the office of notary-public be held by laymen and not by the clergy, renewing an old Carolingian ban reiterated by pope Innocent III in a decretal dated 1213.
