Compreendida a vulnerabilidade e a fragilidade das pessoas mais velhas perante fenómenos de violência, não é possível ignorar as suas necessidades de tutela durante um período “atípico” de pandemia, em que se reforçam factores de risco, e as rodeiam novos perigos: idade/vulnerabilidade, isolamento/dependência, sobrecarga do cuidador/tensões causadas pelo confinamento/ dificuldades económicas associadas à crise. O problema não pode ser adequadamente colocado e resolvido em termos temporalmente limitados e condicionados a um momento de crise — que esperamos transitória —, pelo que é analisado e discutido em termos gerais, à luz dos vários ramos do ordenamento jurídico, em particular do direito penal, constitucional e sucessório.
Once the vulnerability and fragility of older people to phenomena of violence is understood, it is not possible to ignore their need for protection during an “atypical” pandemic period, in which risk factors are reinforced, and new dangers surround them: age/vulnerability, isolation/dependence, caregiver overload/tension caused by confinement/economic difficulties associated with the crisis. The problem cannot be adequately solved in temporally limited terms and conditioned to a moment of crisis — which we hope is transitory — so it is analyzed and discussed in general terms in light of the various branches of the legal system, in particular criminal law, constitutional law and inheritance law.
