The purpose of this article is to briefly describe the position expressed by the Constitutional Court of Portugal in its Ruling 5/2023, where the Court declared the unconstitutionality of the second legal initiative approved by the Parliament aimed at decriminalizing and regulating medically assisted death in the Portuguese legal system.
