| dc.description.abstract | As novas tecnologias têm propiciado mudanças inegáveis e irreversíveis no tecido social. A Revolução 4.0, também chamada de Quarta Revolução Industrial ou Inovação Tecnológico-Comunicativa inaugurou um novo paradigma, quando comparada aos impactos da revolução anterior. Ao lado das transformações na organização empresarial das atividades econômicas, que contam cada vez mais com novos modelos de negócios, observa-se uma ressignificação da noção de dinheiro. A moeda, bem móvel que corporifica uma unidade de valor suscetível de troca, foi essencial para o desenvolvimento do comércio e está intimamente ligada com a atividade empresarial atualmente, não obstante esteja a ganhar novo significado com o fenômeno das criptomoedas. No entanto, mais importante ou revolucionário do que a própria criptomoeda é a funcionalidade que está por trás dela e a disrupção que provocou nos mais variados setores da vida em sociedade. A tecnologia que permite criar uma criptomoeda, também faz possível desenvolver os smart contracts, tema do presente estudo. Para tanto, inicialmente verificamos a importância da tecnologia blockchain para, em seguida, avaliar quais delas podem servir de base para a criação dos chamados contratos inteligentes. À partir deste ponto, então, será possível a análise destes contratos, se é que realmente o são, suas principais características, vantagens na sua utilização e desafios a serem vencidos a fim de assegurar a tutela privada dos direitos de crédito que deles advém. | pt_PT |
| dc.description.abstract | New technologies have provided undeniable and irreversible changes in the social fabric. The 4.0 Revolution, also called the Fourth Industrial Revolution or Technological-Communicative Innovation, inaugurated a new paradigm, when compared to the impacts of the previous revolution. Alongside the transformations in the business organization of economic activities, which increasingly rely on new business models, there is a re-signification of the notion of money. Currency, a movable good that embodies a unit of exchangeable value, was essential for the development of commerce and is intimately linked with business activity today, although it is gaining new meaning with the phenomenon of cryptocurrencies. However, more important, or revolutionary than the cryptocurrency itself is the functionality behind it and the disruption it caused in the most varied sectors of life in society. The technology that makes it possible to create a cryptocurrency also makes it possible to develop smart contracts, the subject of this study. To do so, we initially check the importance of blockchain technology and then assess which of them can serve as a basis for creating the so-called smart contracts. From this point on, then, it will be possible to analyze these contracts, if they really are, their main characteristics, advantages in their use and challenges to be overcome to ensure the private protection of the credit rights that arise from them. | pt_PT |
