| dc.description.abstract | O disposto no art. 60º do Código de Direito de Autor e dos Direitos Conexos permite que se façam modificações na obra arquitectónica sem o consentimento do arquitecto. A consulta ao arquitecto não é obrigatória e apenas é necessária para que as modificações sejam legais, não dando estas lugar a indemnização, mesmo que o arquitecto não concorde com elas. Quando as modificações se fazem contra a vontade do arquitecto, consultado para o efeito, a única coisa que pode acontecer é que este renuncie à autoria, hipótese em que quem fez as alterações não autorizadas não poderá invocar o nome do autor, sob pena de cometer um ilícito e ter que ressarcir o arquitecto. Não nos parece que esta seja a melhor forma de proteger os direitos de integridade e genuinidade dos arquitectos, sendo preferíveis outras soluções mais protectoras. | pt_PT |
| dc.description.abstract | Article 60º of the Portuguese Copyright Law allows for any modifications in the architectural work without the architect’s consent. It is only required to ask for the architect’s opinion on the modifications and these may be brought about even without his consent. The architect’s opinion is not mandatory and is only necessary to assure that the modifications are legal, not requiring indemnity. Once the modifications are applied without the consent of the architect, the only thing that can happen is that the architect may not be named as author if he renounces authorship or else an indemnity will be required. Perhaps this does not protect architects moral integrity an authenticity rights the way it should, and other more protective solutions would be preferable. | |
