Padrão damier azur: icónico, mas não distintivo?

| dc.description.abstract | O caráter expansivo do direito de marcas conduziu à possibilidade de registo das marcas não tradicionais, em que se incluem as marcas padrão, que se integram e se confundem com a aparência dos bens que designam. A tensão entre o desejo de os operadores económicos contarem com estes instrumentos de diferenciação e a necessidade de manter a sua livre disponibilidade no mercado, para usos diversos dos marcários, está patente nas decisões do EUIPO e do TG no caso Damier Azur da Louis Vuitton Malletier, objeto deste estudo. A solução tem passado por negar o caráter distintivo inerente deste padrão, mas admitir, em teoria, o seu caráter distintivo adquirido através do uso em toda a UE. | dc.description.abstract | The expansive nature of trademark law has led to the possibility of registering non-traditional trademarks, including pattern trademarks, which are integrated and confused with the appearance of the products they designate. There is a tension between the desire of economic operators to rely on these instruments of differentiation and the need to maintain their free availability on the market for uses other than trademarks. This tension is evident in the decisions of EUIPO and GC in the case of Damier Azur of Louis Vuitton Malletier, object of this study. The solution has been to deny the inherent distinctive character of this pattern, but to admit, in theory, its secondary meaning throughout the use the in all EU.
