- Legal regime of worker cooperatives in portugal: the state-of-the-art and reform linesPublication . Meira, Deolinda; Martins, André Almeida; Fernandes, Tiago PimentaThis paper offers reform lines of the legal regime of worker cooperatives, which take into account the specific status of co-operator-worker. The legislative proposals are outlined on the basis of the conclusions drawn from the study on "Employment relations in Portuguese cooperatives", held under the International Program entitled "Legal status of workers – members of cooperatives and other organizations of the social and solidarity economy”. The data of the empirical study of the project demonstrate the existence of self-regulation by the cooperatives, which has translated into the application to workers co-operators of a labour law regime. Moreover, the analysis of the Portuguese doctrine and jurisprudence produced on the labour relations in the cooperatives evidenced the existence of great oscillations as to the question of the legal nature of the bond between a co-operator worker and a cooperative.

However, the challenges faced by these cooperatives have unique features arising from their special characteristics compared to other types of cooperatives. Therefore it is vital to study these challenges and the impacts of covid-19. This study has as main goal to understand those challenges and their impact. An exploratory study was undertaken by applying 11 interviews to 11 social solidarity cooperatives. The cooperatives were chosen to be heterogeneous among the existent cooperatives in Portugal. This study corresponds to the first phase of a project that is still underway. This article presents the main results of the content analysis of the data collected from the interviews. Data show cooperatives could promptly adapt and continue their mission under pressure from the pandemic despite the first difficulties encountered in a new and unknown situation, showing a capacity to adapt and serve their members. However, these members were also submitted to several increasing and new challenges. The adaptations were possible due to legal changes in the work organisation law, from layoff to telework, government support involving financial programs, VAT, and other tax relaxation, as well as due to human resources reorganisation and the cooperatives’ staff positive attitude towards the difficulties (both leaders and general workers). Differences between the social solidarity cooperatives under study concerning digital technologies showed that those already having some infrastructure had minor adapting difficulties.
- Regime jurídico das cooperativas de trabalho em Portugal: estado da arte e linhas de reformaPublication . Meira, Deolinda; Martins, André Almeida; Fernandes, TiagoEste texto apresenta linhas de reforma do regime jurídico das cooperativas de trabalho, que tenham em consideração o estatuto específico do cooperador trabalhador. As propostas legislativas são delineadas com base nas conclusões do estudo sobre «As relações de trabalho nas cooperativas em Portugal», realizado no âmbito do Programa Internacional denominado «Estatuto jurídico de los trabajadores-socios de cooperativas y otras organizaciones de la economía social y solidaria». Os dados do estudo empírico do projeto demonstram a existência de uma autorregulação por parte das cooperativas, a qual se tem traduzido na aplicação aos cooperadores trabalhadores de um regime juslaboral. Acresce que a análise da doutrina e da jurisprudência portuguesas produzidas sobre as relações de trabalho nas cooperativas evidenciou a existência de grandes oscilações quanto à questão da natureza jurídica do vínculo que une cooperador trabalhador e cooperativa.
