Diante de uma sociedade onde se discute o seu próprio papel e o do Estado dentro das políticas de assistencialismo, a questão da responsabilização pelos danos emergentes de acidentes de trabalho tem papel relevante e inspira uma análise pela ótica da imputação da responsabilidade social ou da responsabilidade privada. O objetivo do presente estudo foi permitir uma investigação da opção de Portugal de modo a questionar se as disposições da Constituição da República Portuguesa indicam um possível posicionamento em favor da adoção da responsabilização social nessa matéria e consequentemente as vantagens desse sistema.
Faced with a society where its own role and that of the State within welfare policies are discussed, the issue of responsibility for damages arising from accidents at work plays a relevant role and inspires an analysis from the perspective of the imputation of social responsibility or private responsibility. The aim of this study was to allow an investigation of the Portugal’s option in order to question whether the provisions of the Constitution of Portuguese Republic indicate a possible position in favor of adoption of social responsibility in this area and consequently the advantages of this system.
