Abstract(s)
O direito do trabalho é um dos setores do ordenamento jurídico que, pela sua própria natureza, é mais afetado pelas mudanças tecnológicas. As novas tecnologias de informação e comunicação pela sua facilidade e capacidade de permitir trabalhar em qualquer lado, a qualquer tempo, são benéficas para a gestão empresarial, mas simultaneamente, colocam questões ao direito laboral.
Neste estudo procuramos analisar o problema que se prende com o trabalhador constantemente conectado e as questões associadas ao tempo de descanso.
Por outro, analisamos a solução legislativa que surgiu no ordenamento jurídico francês, que se espalhou um pouco por toda a Europa e aparece contemporaneamente a ser discutida no Parlamento Português, o direito à desconexão.
Com o objetivo de melhor acautelar os interesses dos trabalhadores e das empresas, analisamos o sistema jurídico português e a discussão parlamentar em Portugal.
The labor law is one of the legal fields that by its own very nature is most influenced by technological changes. This new era of information and communication technology that enables the worker to work anywhere, at any time create new issues for the labour law. In this study we try to analyze the problem of the worker constantly connected. This raises questions about the time of rest and working time. We analyze the legislative solution that began in the French legal system. This solution spread a little throughout Europe and we analyse the right to disconnect in the Portuguese legal system. In order to better safeguard the interests of workers and companies, we have come up with a review of the Portuguese law.
