O presente trabalho analisa o direito à reposição do equilíbrio económico-financeiro na esfera do concedente. Procura-se observar as caraterísticas dos contratos de concessão e a relevância que o risco, a sua identificação e distribuição assumem na determinação do quadro de regulação do equilíbrio económico-financeiro. Avalia-se, à luz da teoria da reposição do equilíbrio financeiro, a existência do direito a favor do concedente e os termos e condicionalismos da sua efetivação.
This paper concerns the right to restore the financial balance of concessions contracts in the legal sphere of the public contracting entity. It analyses the characteristics of concession contracts and the relevance of risk and risk distribution between the contracting parties to determine the framework in which financial balance arises. It aims to assess, considering the financial rebalancing theory, the existence of the right in favour of the public contracting authority and the terms and conditions of its implementation.
