A nossa exposição iniciar-se-á com um enquadramento do tema, explicando o conceito da indústria 4.0, as suas vantagens e desvantagens, as repercussões que surgem na esfera do trabalhador e um enquadramento do direito à desconexão. Partiremos, depois, para a apreciação e verificação da proteção jurídica dos direitos em causa, a nível internacional e europeu, e, em especial, no nosso ordenamento jurídico. Por fim, cumpre analisar o regime jurídico francês, uma vez que foi pioneiro nesta matéria, e referir os trabalhos preparatórios de nova legislação sobre a matéria que têm sido apresentadas em Portugal. O objetivo deste estudo é alertar para o impacto da indústria 4.0 nos direitos dos trabalhadores e, a propósito do exemplo francês, analisar o nosso ordenamento jurídico de modo a apurar se o mesmo já consagra, ou não, o direito à desconexão.The aim of this dissertation is to analyse the recent discussions around the right to disconnect, as a result of the revolution brought by the industry 4.0. This work starts by presenting a theoretical framework that explains the concept of the industry 4.0, its advantages and disadvantages, the impacts it has on the lives of workers and also provides context for the right to disconnect. It is followed by an evaluation and verification of the judicial protection of the rights in question on three levels: international, European and, in particular, within our legal system. Lastly, it looks into the French legal framework, for it was pioneer in this matter, and refers the preparatory work for new legislation on this issue that has been presented in Portugal.
