Para tal, será efetuada uma análise da Justiça Restaurativa, tentando definir a mesma conceptualmente e analisar as finalidades que pretendem ser cumpridas. Para mais, será feita uma breve analise à mediação penal e ao seu atual paradigma em Portugal, avaliando a possibilidade da sua implementação à fase do cumprimento da pena. Serão também exploradas as diversas teorias sobre quais os fins das penas criminais, e a adequação destes institutos para o cumprimento das mesmas.This dissertation aims to investigate whether the implementation of restorative solutions in parallel to the fulfilment of criminal sentences has an influence on the fulfilment of the purposes of criminal sentences. To this end, an analysis of Restorative Justice will be carried out, trying to define it conceptually and analyse the purposes that are intended to be fulfilled. Furthermore, a brief analysis will be made of criminal mediation and its current paradigm in Portugal, assessing the possibility of its implementation at the stage of sentence fulfilment.
