This study examines the topic through a legal lens, drawing on Human Rights Law, International Humanitarian Law (IHL) and International Criminal Law (ICL). The analysis is based on a variety of sources, such as research, reports, surveys and personal testimonies to demonstrate how the war contravenes a set of legal provisions. The findings reveal not only the challenges endured by women but also unveil their unprotected status. To address the situation adequately, it is crucial to enhance legal frameworks, especially in regard to women’s rights and strengthen accountability mechanisms to make justice for the victims. Concurrently, such reinforcements can also prevent future violations of rights.A presente dissertação analisa a violação dos direitos das mulheres na Faixa de Gaza depois do ataque de 7 de outubro de 2023, através de uma perspetiva legal, destacando se, designadamente, as sistemáticas violações pelos Direitos Humanos, pelo Direito Humanitário Internacional e pelo Direito Penal Internacional. A análise teve por base a recolha de informação em várias fontes, nomeadamente, pesquisa, relatórios e testemunhos que demonstram o paradoxo entre as normas legais e a guerra em Gaza.
