Access to metadata, provided by its retention, has therefore emerged as a means of acquiring evidence adapted to the current reality and essential for investigating certain crimes. However, since this means of obtaining proof restricts important fundamental rights, the search for a balance between the State's duty to guarantee security and the necessary protection of the rights being restricted is crucial. The question is to understand to what extent the restriction of rights, freedoms and guarantees of a certain group of citizens is tolerable in the name of a constitutionally protected value, such as security, which affects the entire community.No atual contexto digital, onde a fronteira entre o mundo físico e o mundo digital se mostra cada vez mais ténue, os instrumentos tradicionais processuais não se revelam aptos a dar resposta ao combate à criminalidade grave. O acesso a metadados, possibilitado pela sua conservação, surge, assim, como um meio de aquisição probatória adaptado à realidade atual e indispensável para a investigação de certos crimes. Contudo, restringindo este meio de obtenção de prova importantes direitos fundamentais, a busca pela concordância prática entre o dever do Estado em garantir a segurança e a necessária tutela dos direitos restringidos revela-se crucial.
