Em colisão podem estar o direito da criança à satisfação das suas necessidades, sendo uma delas a eliminação da situação de perigo, que consecutivamente lhe permita viver harmoniosamente, junto de uma família e o direito dos progenitores à educação e manutenção dos filhos. Pretende-se, portanto, saber se a intervenção estadual é realizada através de uma adequada ponderação dos interesses em causa ou, se pelo contrário, excede ou fica aquém dos requisitos de admissibilidade postulados.The present master’s dissertation aims to analyze, under the Law for the Protection of Children and Young People in Danger, how are the principles of the best interest of the child and the prevalence of family articulated, through the actions of the protection commissions and courts. In conflict may be the child’s right to the satisfaction of their needs, one of which is the elimination of the dangerous situation, which allows them to subsequently live harmoniously, within a family, and the parent’s right to education and maintenance of their children.
