Dúvidas não existem no que toca em enquadrar a garantia autónoma no seio das garantias pessoais, ainda que não esteja legalmente prevista. A presente análise que nos propusemos terá como objetivo revisitar a garantia autónoma, na sua modalidade “on first demand”. Assim sendo, iremos expor as diversas relações que emergem da garantia autónoma, explicando as demais características das mesmas. De todo o modo, o foco do nosso trabalho será a natureza jurídica da obrigação do garante na garantia autónoma. Tentaremos, em primeira análise, reconstruir tal obrigação e, numa segunda fase, iremos tentar descortinar a génese da obrigação.n the middle of the twenth century, the autonomous guarantee was born, due to the growing of the international trade. There are no doubts that the autonomous guarantee is a personal guarantee of obligations. However, it does not have legal provision. This review that we have set ourselves will have the mission to revisit the autonomous guarantee, in particular, the autonomous guarantee on first demand. Therefore, we will expose the relationships which emerge from this figure, explaining their characteristics.
