Perante a necessidade de fazer face aos problemas colocados pelo aumento da alta criminalidade e criminalidade organizada, e tendo em conta o aumento da lentidão da justiça, reacende-se a discussão sobre a possibilidade de seguirmos as tendências europeias e internacionais no sentido da opção pela justiça negociada. Um dos institutos que surge como uma via possível para o combate destas lacunas é o instituto da delação premiada. Desta forma, a presente dissertação aborda questões como a (in)compatibilidade da delação premiada com o processo penal português e a (im)possibilidade de recorremos a este instituto de forma a suprir algumas deficiências do nosso sistema, optando por seguir uma lógica de consenso e oportunidade em prol de uma justiça mais célere e eficaz.The criminal justice in Portugal has come to show itself fragile towards the new challenges that arise with the evolution and transformation of the society. Faced with the need to cope with the problems caused by the increase of the already high level of criminality and organized crime, and in consideration of the already slow procedural pace of justice, the discussion resurfaces about the possibility to follow the European and International patterns in the way of negotiated justice. One of the institutes that is at the heart of the issue and appears as a solution to fight this loophole is the institute of DELAÇÃO PREMIADA.
