Para tal, recorre à mediação da ética, considerando esta dimensão da ação humana e compreensão do mundo como fonte de humanidade e dos correspondentes direitos. Nesse contexto, contudo, a diversidade de propostas fundamentadores implicam uma análise crítica. Através dessa análise, percebe-se que a questão ética nos leva para lá do direito, em sentido estrito, abrindo a possibilidade de uma dimensão de gratuidade e de incondicionalidade anterior à própria ética. É nessa dimensão que se insere a experiência do amor, como possível “direito” humano não sujeito a preceitos. É precisamente nesse campo que o excesso evocado permite estabelecer uma relação com a dimensão teológica e, ao mesmo tempo, perceber uma possível ligação entre Direitos Humanos e teologia.The article intends to answer the question of the foun- dation of Human Rights. To this issue, it uses the mediation of ethics, considering this dimension of human action and under- standing of the world as a source of humanity and correspond- ing rights. In this context, however, the diversity of substantive proposals imply a critical analysis. Through this analysis, it is per- ceived that the ethical issue takes us beyond the right, in the strict sense, opening the possibility of a dimension of gratuitous- ness and of unconditionality previous to the ethics. It is in this dimension that the experience of love is inserted, as a possible human “right” not subject to precepts.
