Contudo, este trabalho versará apenas na análise desta figura no contexto do direito societário português, nomeadamente, no tocante ao CSC e ao CVM. Desta forma, tentaremos demonstrar as características que configuram ou delimitam esta figura, averiguar através de que meios poderemos alcançar o domínio e bem assim, quais as consequências jurídicas que lhe surgem associadas. Com esta análise procuraremos igualmente responder à pergunta que muito se coloca: qual a necessidade do legislador em criar para uma mesma realidade duas normas jurídicas ou dois regimes jurídicos distintos?Dominant influence relationships have a cross-sectional character and, as such, are evident in several areas of Law. However, this paper only addresses this institute’s analysis within Portuguese corporate law, namely, as far as the Commercial Companies’ Code and the Portuguese Securities Market’s Code are concerned. Therefore, we try to establish the features that characterize or limit this institute, ascertain the means through which we can establish dominant influence relationships and determine the legal consequences that are associated with such relationships.
