Como analisaríamos mais adiante, a qualificação dos contratos não ocupa relevância num plano meramente teórico, constituindo um passo necessário para que seja possível, com rigor, averiguar qual as normas que devem ser aplicáveis em caso de incumprimento contratual. Assim, surgiu o interesse de explorar qual a tipologia contratual que rege a relação entre controller e processor, uma vez que o RGPD se revela omisso nesta matéria. Desta forma, estando a proteção de dados na ordem do dia, optamos por focar o tema desta dissertação na figura do processor. Apesar de o RGPD ter depositado, em relação à anterior diretiva, maior atenção a esta figura, a possibilidade de agora ser responsabilizado diretamente perante o titular dos dados, despoletou a vontade de clarificar a natureza contratual do mesmo e respetivo regime obrigacional.The present dissertation will have as main objective to qualify the contract of the processor. As we will analyze below, the qualification of the contracts is not of a purely theoretical nature and constitutes a necessary step in order to be able to rigorously ascertain which rules should apply in the event of a breach of contract. Thus, the interest of exploring the contractual typology governing the relationship between controller and processor arose, since the RGPD turns out to be lacking in this matter. In this way, since data protection is the order of the day, we chose to focus the theme of this dissertation on the figure of the processor.
