Neste sentido, distinguimos as duas sanções criminais, mencionando as suas finalidades e princípios constitucionais subjacentes. Numa análise aprofundada da medida de segurança de internamento, procuramos identificar a quem pode ser aplicada, com que pressupostos e limites, sem descurar a evolução histórica da figura na ordem jurídica portuguesa e na doutrina jurídica em geral, nomeadamente quanto ao seu aparecimento e consagração. Estudamos a medida de segurança mais restritiva da liberdade: o internamento, questionando se os limites para a aplicação da medida de segurança de internamento tal como configurados na nossa lei penal estão em consonância com os princípios e os correspondentes direitos fundamentais, expondo o entendimento da doutrina e a nossa posição quanto a esta questão.This work aims to give an approach of security measures in opposition of penalties, because these are the criminal responses planned by the portuguese criminal law for the comission of a crime. In this sense, we distinguish these two criminal responses, referring also their purposes and the constitucional principles envolved. In a deepest analysis of the security measure of internment, we look to identify to whom the first can be applied, how and what are the limits to it, not forgetting the historical evolution of this figure in the portuguese legal system and general legal doctrine praticularly, it’s appearance and consagration. We focus our work at the security measure more restrictive of liberty to the infractor: the internment.
