| dc.description.abstract | O terrorismo está no centro das discussões nas sociedades contemporâneas. A sociedade global vê-se atualmente, quase diariamente, confrontada com este fenómeno que tem desencadeado uma paranoia coletiva em torno da segurança. Acredita-se que, se deve limitar a liberdade para se salvar a liberdade. O direito penal como instrumento de liberdade vê-se hoje confrontado com uma crescente demanda de segurança. Assistimos a um Direito Penal que se desenvolve numa “sociedade de risco” e cuja a identidade é posta à prova. Perante os novos riscos e de forma a combater os novos perigos da sociedade caraterizada como de “risco”, têm sido defendidas concepções próximas do Direito Penal do Inimigo, teoria desenvolvida pelo jurista alemão Günther Jakobs. Analisaremos as raízes, expansão e características deste movimento securitário, e consequentemente a sua relação com os princípios estruturantes do Estado de Direito | pt_PT |
| dc.description.abstract | Terrorism is at the centre of the discussion in contemporary societies. Global society is currently, almost daily, throwing up, with the abovementioned phenomenon which has triggered a collective paranoia regarding security. It is believed that it should be limited the freedom to save the freedom. Nowadays, criminal law as an instrument of freedom is confronted with an increasing claim for security. We are witnessing a criminal law that develops in a "society of risk" and whose identity is tested. In view of the new risks, and in order to combat the new dangers of society, which has been characterized as "risk", have been defended concepts close to the Criminal Law of the Enemy, developed by the German jurist Günther Jakobs. We will analyse the roots, the expansion and also the characteristics of this security movement, as well as the relation with the Rule of Law’s structuring principles. Keywords: Terrorism; | pt_PT |
